1. Agreement to these terms
These Terms of Use (“Terms”) are a legal agreement between you and To Go Green, LLC (“To Go Green,” “we,” “us,” “our”) governing your use of the Unpaq mobile application and unpaq.togogreen.eco (together, the “Service”). By downloading, accessing, or using the Service you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. What Unpaq does
Unpaq lets you submit product information — a barcode, a photo of a product or its label, a link to an online listing, or a typed description — and returns a 0–100 chemical-exposure-potential score. Each report may include a confidence rating, per-axis exposure drivers, cited evidence from published sources, and suggested lower-exposure alternatives. Reports can be saved to a personal history and rolled up into an exposure index.
3. Important disclaimer: scores are estimates
Unpaq scores are informational exposure-potential estimates computed by a deterministic ruleset from packaging materials, ingredients, product category, and published hazard research. Unless a report is explicitly marked lab-tested:
- a score is not a measurement of the specific product unit you hold;
- a score is not a laboratory result, toxicity determination, or contamination reading;
- a score is not a guarantee that a product is safe or unsafe to use.
Unpaq does not provide medical, health, toxicological, legal, or safety advice, and the Service is not a substitute for professional judgment, regulatory guidance, or the product label itself. If you are pregnant, managing a health condition, have allergies or chemical sensitivities, or are evaluating products for infants, consult a qualified professional. Never disregard professional advice because of something you saw in the app.
4. Automated and AI-assisted analysis
When you submit a photo, machine-learning models (including third-party vision APIs) extract a product identity — name, materials, and ingredients — which then feeds our deterministic scoring ruleset. Extraction output can be inaccurate or incomplete: a misidentified ingredient or material will produce a misleading score, so always verify the extracted details shown in your report against the physical label. Scores themselves are never generated by AI — the same inputs always produce the same score.
By granting camera or photo-library access you consent to submitted images being transmitted to our backend and vision providers solely to produce your result. Photos are processed transiently and are not retained beyond what is needed to return the extraction. You can withdraw this consent at any time by revoking the permission in your device settings; barcode, link, and text scans keep working without it.
5. Data accuracy and limitations
Product identities come from public and licensed databases (the Open Food Facts family, PubChem, EPA CompTox, UPCitemdb, Go-UPC), from product pages you link, and from photos you submit. These sources can be incomplete, outdated, region-specific, or wrong, and manufacturers reformulate products without notice. Scores reflect our published ruleset at the time of the scan and may change as data and methodology improve. A low score is not a certification; a high score is not an accusation. Always check the physical label.
6. Eligibility and your account
You must be at least 13 years old (16 in the EEA/UK) to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms. App-store age ratings describe content suitability; they do not change these eligibility requirements. Unpaq works without an account; usage is tied to an anonymous device identifier. You are responsible for activity on your device and for keeping device access secured.
7. Free tier and Premium subscriptions
6.1 Free tier
The free tier includes 5 analyses per day, resetting at midnight local time. We may adjust free-tier limits with notice.
6.2 Premium subscription
Unpaq Premium removes the daily cap and unlocks additional features. Pricing shown in-app and on this site is in USD (currently $4.99/month or $29.99/year; local pricing may vary by storefront). New yearly subscribers may receive a 3-day free trial where offered.
6.3 Billing, auto-renewal, and cancellation
- Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
- Subscriptions automatically renew at the then-current price unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- Free trials convert to paid subscriptions unless cancelled at least 24 hours before the trial ends. Any unused trial portion is forfeited when you purchase a subscription.
- Manage or cancel in your device’s subscription settings: iOS — Settings → your name → Subscriptions → Unpaq; Android — Play Store → profile → Payments & subscriptions → Subscriptions → Unpaq.
- Deleting the app does not cancel your subscription. Cancellation takes effect at the end of the current paid period.
- Refunds are governed by the app store’s refund policy; requests go through Apple or Google directly.
- If we change subscription pricing, the store’s price-change consent rules apply and your subscription continues only with your consent where required.
7.4 App-store terms
When you download Unpaq from the Apple App Store or Google Play, the applicable store’s terms also apply. Apple and Google are not responsible for the Service, its content, or any claims relating to it, and have no obligation to provide maintenance or support for it. Your license to use the iOS app is limited to Apple-branded devices you own or control as permitted by the App Store’s usage rules. Apple and Google are third-party beneficiaries of these Terms with respect to the app and may enforce them accordingly.
8. License and acceptable use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. You agree not to:
- bulk-scrape, crawl, or systematically extract reports, scores, alternatives, or underlying data from the Service or the databases it queries;
- probe, overload, reverse-engineer, or interfere with the app, backend, or related infrastructure;
- republish Unpaq scores or reports as laboratory measurements, regulatory findings, or certifications;
- use the Service to make claims about a product’s legal compliance or to misrepresent our estimates to others;
- submit content you have no right to share, that is unlawful, or that infringes others’ rights;
- circumvent the free-tier quota, subscription checks, or any technical limitation;
- resell, sublicense, or commercially exploit the Service.
We may rate-limit, suspend, or terminate access for abuse, with or without notice.
9. Your content
You retain rights to photos and text you submit. By submitting content for analysis you grant us a limited license to process it solely to operate and improve the Service (for example, to extract a product identity from a photo). Submitted photos are not retained beyond processing, as described in the Privacy Policy. If you send us feedback or suggestions, you agree we may use them without obligation or compensation.
10. Intellectual property
The Unpaq name, logos, app design, scoring ruleset, website content, and all related intellectual property are owned by To Go Green, LLC or its licensors. You may share screenshots of your own reports — including in reviews and social posts — provided you present scores as estimates and do not misrepresent them as lab results or certifications.
If you believe content in the Service infringes your copyright, send a notice to [email protected] with the work identified, the material claimed to infringe, your contact details, and a good-faith statement under penalty of perjury that the use is unauthorized. We respond to notices that comply with 17 U.S.C. §512.
11. Third-party services, links, and products
The Service relies on third-party databases, app stores, and infrastructure providers. Safer-swap suggestions link to third-party retailers; we do not sell, stock, endorse, or warrant those products, and the retailer’s own terms and policies apply to any purchase. Some links may be affiliate links that earn us a commission at no extra cost to you. We are not responsible for third-party content, pricing, availability, or practices.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SCORES, REPORTS, OR ALTERNATIVES ARE ACCURATE, COMPLETE, OR SUITABLE FOR ANY DECISION.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TO GO GREEN, LLC AND ITS OFFICERS, EMPLOYEES, AND LICENSORS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR DECISIONS MADE IN RELIANCE ON SCORES, REPORTS, OR ALTERNATIVES. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR FIFTY U.S. DOLLARS IF YOU PAID NOTHING. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITS; WHERE THAT IS THE CASE THEY APPLY TO THE FULLEST EXTENT PERMITTED.
14. Indemnification
You agree to indemnify and hold harmless To Go Green, LLC from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service, your breach of these Terms, or content you submit without the right to do so.
15. Governing law and disputes
15.1 Governing law
These Terms and any dispute arising from them are governed by the laws of the District of Columbia, excluding its conflict-of-laws provisions, and controlling U.S. federal law. The UN Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transactions Act do not apply. For any proceedings not subject to arbitration, you and To Go Green, LLC submit to the exclusive jurisdiction and venue of the state and federal courts located in the District of Columbia.
15.2 Informal resolution first
Before commencing arbitration, the party bringing a claim must email [email protected] with their name, contact details, and a description of the claim, and participate in a good-faith informal resolution conference within 60 days of the other party receiving that notice. Completing this step is a precondition to arbitration — a filing made without it may be dismissed, and the non-compliant party may be ordered to cover the other side’s filing costs. Limitations periods and filing-fee deadlines are tolled while informal resolution is underway.
15.3 Binding arbitration
If a dispute isn’t resolved informally, it will be resolved exclusively by final and binding arbitration before a single, neutral arbitrator administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this agreement. The arbitrator decides all issues, including the scope and arbitrability of this clause, and may award the same individual relief a court could. Hearings may be held virtually or in a reasonably convenient location; a claim may be decided on documents alone. Either party may instead bring an individual claim in small-claims court or seek injunctive relief for misuse of intellectual property.
15.4 No class or representative actions
To the fullest extent permitted by law, you and To Go Green, LLC each waive the right to a jury trial and to participate in — or seek relief through — any class, collective, consolidated, mass, or representative action, including class arbitration. All claims must proceed in an individual capacity only.
15.5 Fees, confidentiality, and opt-out
- Filing, administrative, and arbitrator fees are governed by the AAA Rules; if arbitration costs would be prohibitive for you compared to litigation, we will reimburse what the arbitrator deems necessary, unless your claims are found frivolous.
- Arbitration proceedings, rulings, and awards are confidential except as required by law or to enforce the award.
- You may opt out of arbitration and the class waiver by emailing [email protected] within 30 days of first accepting these Terms.
- If any part of this dispute-resolution agreement is unenforceable, the rest remains in effect; if claims must proceed on a class or representative basis, they proceed in the District of Columbia courts described above.
- Where your local consumer-protection law provides non-waivable rights, venues, or remedies, those apply instead, and nothing in these Terms limits them.
16. Termination
You may stop using the Service at any time by uninstalling the app. We may suspend or terminate access for breach of these Terms. Sections that by their nature should survive (including disclaimers, liability limits, indemnification, and governing law) survive termination.
17. General
- Changes. We may update these Terms as the Service evolves. The date above reflects the latest version; material changes will be flagged in the app or on this site. Continued use after an update constitutes acceptance.
- Severability. If a provision is unenforceable, the rest remain in effect.
- Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or asset sale.
- Entire agreement. These Terms plus the Privacy Policy are the entire agreement between you and To Go Green, LLC regarding the Service.
- No waiver. Our failure to enforce a provision is not a waiver of it.
